Respecting the intellectual property rights of third parties, we address claims of unauthorized sharing of copyrighted materials on our Platform in accordance with the safe harbor provisions of the Digital Millennium Copyright Act (DMCA). We also have the prerogative to disable or terminate Platform access for users who may infringe or repeatedly infringe copyrights, as per the DMCA.

Notification of Alleged Copyright Infringement

If you believe that your work has been copied and made available through the Platform in a manner constituting copyright infringement, you can provide us with a written document (“Notice”) containing the following details:

  • Description of the copyrighted work allegedly infringed.
  • Identification of the URL or specific location of the material containing the claimed infringement.
  • An electronic or physical signature of the copyright owner or authorized representative, along with a statement that the disputed use isn’t authorized.
  • A statement certifying the accuracy of the notice and your authority to act on behalf of the copyright owner.
  • Your contact information: name, mailing address, telephone number, and email.

Upon receiving valid notification, we will remove or disable access to the alleged infringing material and notify the alleged infringer. We will also inform the alleged infringer of the DMCA counter-notice process (section B), through which they can respond and request material reinstatement.

Counter-Notice

Procedure If you believe your copyrighted material was wrongly removed from the Platform, you can submit a written counter-notice to our Designated Agent (details above) containing:

  • Identification of the removed or disabled material and its previous location.
  • A statement agreeing to the jurisdiction of the federal district court in your area.
  • Statement of acceptance of process service from the party filing the original notice.
  • Your contact information: name, address, and phone number.
  • Statement, under penalty of perjury, that the removal was due to mistake or misidentification.
  • Your physical or electronic signature.

Upon receiving a valid counter-notice meeting the criteria, we will reinstate your material within 10 to 14 working days, unless our designated Agent receives notice of a legal action related to the material.

Policy on Repeat Infringement

In alignment with the DMCA and relevant laws, we may, at our discretion, disable or terminate Platform access for users who infringe or repeatedly infringe copyrights. This determination is based on the number of “strikes” against a user, with each adjudication of copyright infringement being a separate strike. We operate under a “three strikes, and you’re out” policy, where a user with three strikes is considered a repeat infringer and may face account termination.
